The majority of children killed in a traffic accident are not subject to the retention system

Every time we intend not to place the baby or child in the safety device (because we are close, because there is a hurry ...) we would have to think about these figures to discard the idea. The Public Prosecutor's Office of Road Safety has commissioned a study on child accidents in which the large number of children who do not travel correctly subject to a restraint system.

The work has revealed some data that evidences the misuse of this type of devices that most parents make, one of the most frequent mistakes that endanger children in the car. 46% of children did not carry any retention system, another 18% carried it but poorly placed and only 30% used it and did it correctly.

The future conclusions of the project being carried out by the Road Safety Prosecutor's Office will be aimed at creating proposals for legislative reforms to reduce child deaths in accidents.

Changes in the law to save children's lives

The project is expected to be completed later this year, and by then the Prosecutor's Office, which works on some aspects in collaboration with the DGT, will present its legislative proposals definitive

In this regard, drivers, in most cases the parents themselves, who suffer a traffic accident with young children who were not properly protected and who are killed or seriously injured have been targeted.

In this way, they propose that if it is possible to demonstrate that the lack of protection of the minor is the cause of more serious injuries or of his death, the driver will see an increase in the penalty that will be requested in a judicial process.

In addition, they intend to promote other measures such as transferring to the Juvenile Prosecutor to study the case, and if the minor needs some form of protection, when the motorist is fined for the third time taking the children without a seat or seat belt. This would add up to 200 euros and loss of three points for each penalty.

Likewise, the prohibition will be requested so that children under 14 cannot travel by any means of public transport (taxis or buses) without the corresponding retention system. In this way we want to eliminate the exemption for taxi drivers so that they also have to use child restraint systems on a mandatory basis.

Accidents with fatalities could have been reduced by 51% if the children had been properly protected. The children are crushed by other occupants of the vehicle, in many cases who was holding them in their lap, or are dismissed outside the passenger compartment.
